Public offer agreement


to conclude an agreement for the provision of charging services for electric vehicles in the ND CHARGER service network
This Offer in accordance with Art. 408 of the Civil Code of the Republic of Uzbekistan is an official public offer of ND CHARGER LLC addressed to individuals, which has the corresponding right under the License Agreement No. Lic-Uz dated 03/01/2023 on granting the right to use the software, which has the right to provide charging services for electric vehicles in the ND service network CHARGER.
The performance of the actions specified in this Offer is an unconditional and unconditional confirmation of the consent (acceptance) of an individual to enter into an Agreement for the provision of services for charging electric vehicles in the ND CHARGER service network under the conditions, in the manner and to the extent set forth in this Offer (hereinafter referred to as the Agreement).
1. Terms, definitions and abbreviations:
Automated control and monitoring system for the network of charging stations of ND CHARGER LLC (hereinafter referred to as the ND CHARGER service)– a set of software and hardware tools, procedures and rules that automate management processes for the provision of electric vehicle charging services, and also allows the User to pay for the Service remotely online at any time and from any interface of the ND CHARGER service, carry out charging sessions, receive statistical information and other service (information) support. ND CHARGER service interfaces include:
a) ND CHARGER mobile application available for IOS and Android platforms;
b) Other interfaces that may be available within the functionality of the ND CHARGER service.

User balance –the amount of funds credited by the user to a special account in the ND CHARGER service, displayed in the user’s account and intended to pay for services provided in the ND CHARGER service.
Bank payment card (hereinafter referred to as BPC) –a personalized plastic card with a magnetic stripe or chip module, which is the key to accessing bank account management and provides its owner with the opportunity to make cashless payments for goods or services in various trade and service enterprises that accept cards for payment, to receive cash at bank branches and ATMs, and also enjoy other additional services and certain benefits.
Charging session– the process of receiving the Service, as a result of which the battery of the electric vehicle is charged, and which lasts from the moment the charging of the battery of the electric vehicle begins until the charging of the battery stops.
Kilowatt-hour (hereinafter referred to as kW/h)– units of measurement of Services.
Mobile application ND CHARGER– software designed to work on smartphones, tablets and other mobile devices, developed for the iOS, Android platforms and providing the ability to use EPS for charging batteries of electric vehicles.
Operator –ND CHARGER LLC, which has the corresponding right under the License Agreement No. Lic-Uz dated 03/01/2023 on granting the right to use the software, has the right to provide charging services for electric vehicles in the ND CHARGER service network
Processing of personal data— implementation of one or a set of actions for the collection, systematization, storage, modification, addition, use, provision, distribution, transfer, depersonalization and destruction of personal data.
Personal Information— information relating to a specific individual or enabling his identification, provided by the User to use the ND CHARGER service.

Payment– movement of non-cash funds paid in national currency, including using international payment cards Visa, Mastercard/Maestro by the User in favor of the Operator in order to pay the Cost of the Service.
Terms of use– means the Rules for the use of electric charging stations of the network of charging stations of ND CHARGER LLC.
Copyright Holder of the License– means a legal entity that is the copyright holder of the software license and with which the Operator has concluded a License Agreement.
Repeat payment for BODis a service that allows the User to register a BPC in a secure environment (system), and then make payments without having to enter any additional data (card number, expiration date and CVV code, etc.).
User of the charging network of ND CHARGER LLC (hereinafter referred to as the User)– a legally capable individual who uses the ND CHARGER service to receive the service of charging electric vehicles at an electric charging station, who has taken actions aimed at concluding an Agreement by accepting the terms of this Offer and has been registered in the ND CHARGER service.
Electric energy meter– a device for measuring and accounting for the amount of electricity supplied during the Charging session and determining the volume provided to the Service User when charging by kW/h.
Registration– the process of obtaining an account in the ND CHARGER service by the User contacting the Operator through the ND CHARGER Mobile application in order to receive the Service and confirm the terms of the Service (including the size, procedure for accrual and payment of the Service), as a result of which the Operator connects the registered User to the ND CHARGER service by creating an individual account (User account). The registered User gains access to his account by entering in the ND CHARGER Mobile Application the login and password received by the registered User upon registration or as a result of their change in the future.

RUz– means the Republic of Uzbekistan.
Charging station network of ND CHARGER LLC (hereinafter referred to as the Charging Station Network)is a network of all electric charging stations, the list of which is published in the ND CHARGER Mobile application and intended for charging batteries of electric vehicles.
Support– a service that provides information and technical support to users. The Help Desk provides support to Users through a special section in the ND CHARGER mobile application (Help Desk), by telephone and email specified in the ND CHARGER Mobile application.
Charging station connector status– color indication of the state of a specific connector at the current moment in the ND CHARGER mobile application: blue – busy, green – available, red – faulty, gray – no connection.
Service cost– the amount of monetary remuneration due to the Operator for services provided to the User, the amount of which is calculated in accordance with the current Tariff and the volume of the Service requested by the User.
Rate– the amount of monetary remuneration established by the Operator for 1 kW/h of the Service provided or for 1 (one) charging session.
Service– this is the result of charging the batteries of the User’s electric vehicle at the Operator’s charging stations using the ND CHARGER service, expressed in kW/h or 1 (one) charging session. The service does not require licensing.
User Account– a set of data about the User stored in the system, necessary for his identification (authentication) and providing access to his personal data, settings, electronic signature, etc.
Color indication of EZS– color indication of the EPS status at the current moment: green – EPS is available, blue – EPS is busy, red – EPS error, yellow – outside working hours (maintenance).
Check– a fiscal electronic document, which is confirmation of payment for the volume of Services provided by the Operator, which contains a QR code and

details in accordance with the requirements of the legislation of the Republic of Uzbekistan on online and virtual cash register systems.
Electric charging station(hereinafter – EZS) – a device for charging batteries of electric vehicles, charging with alternating and/or direct current using a special connector (connector);
Electric car- a vehicle driven by an electric motor and equipped with one or more batteries that can be charged from an external source of electricity.
2. General provisions
2.1. Publication of the agreement form on the Website and (or) in the ND CHARGER Mobile application is an offer to conclude an agreement (offer). The conclusion of the agreement is made by acceptance (acceptance) by the User of the public offer (offer) without any exceptions or reservations.
Filling out the registration form by the user in the ND CHARGER Mobile application and clicking the “Accept” button is the User’s unconditional acceptance of this Agreement and confirmation of the User’s full consent to the terms of the Agreement and the Rules of Use, as well as the fact that the Agreement does not infringe on his rights and legitimate interests.
2.2. By concluding this Agreement, the User provides ND CHARGER LLC, in accordance with the requirements of the legislation of the Republic of Uzbekistan on personal data, with unlimited consent to the processing of their personal data (including, but not excluding: payment credentials, cell phone number, bank card numbers, full name, registration data, as well as any other personal data necessary to use the ND CHARGER service), including collection, recording, systematization, accumulation, storage, clarification (updating, changing), extraction, use, transfer (distribution, provision, access), depersonalization, blocking, deletion, destruction of personal data performed using automation tools or without the use of such means in order to execute this Agreement. The User hereby also agrees to

transfer of any personal data provided by him under this Agreement to third parties for the purpose of fulfilling this Agreement.
2.3. ND CHARGER LLC guarantees the User to take all necessary measures to ensure the confidentiality of the User’s personal data in accordance with the requirements of the current legislation of the Republic of Uzbekistan and the Personal Data Privacy Policy. The User's consent to the processing (including transfer to third parties) of his personal data is unlimited, and consent to the processing of personal data can be withdrawn by the User at any time, in accordance with clause 6.5 of this Agreement.
2.4. Before using the ND CHARGER service, you must fully read the text of this Offer. If you disagree with the terms of the Offer in whole or any part of it, you should refrain from using the ND CHARGER Service.
2.5. This Agreement does not provide for the transfer of property rights to the ND CHARGER service or its components and represents a limited right to use it.
2.6. Any changes to the terms of this Agreement are made unilaterally by the Operator, by setting out a new version of the Agreement in the ND CHARGER Mobile application, while the new terms of service come into force from the moment the new version of the Agreement is posted, unless otherwise stated. The Operator may unilaterally change the terms of this Agreement, but always notifies Users of significant changes. If the User disagrees with any changes to the terms of this Agreement, changes in the Cost or the appointment of new Payments in addition to existing ones, the User may refuse the Services in the manner specified in clause 9.2. and 9.4. actual agreement.
2.7. The User account is personal. The use of the User's personal account by third parties is not permitted. It is also prohibited to create an account in the name of another person or provide false information.

2.8. In case of insufficient funds in the User's client account, non-existent account number or cancellation of payment, the Operator has the right to refuse to provide the service.
2.9. By concluding this Agreement, the User grants the Operator the right to send news, information letters and promotional materials for all services offered by the Operator to the email address and mobile phone number of the User specified during Registration.
2.10. The Operator reserves the right, at its discretion, to provide individually or as part of a broader campaign a full or partial discount on the payment for Services for the selected User and/or Users.
3. Subject of the agreement
3.1. The Operator organizes the provision of Services in the Network of charging stations (specified in the ND CHARGER Mobile Application), and the User accepts and pays within the time limits established by this Agreement for the received Service in the manner and on the terms provided for in this Agreement.
3.2. Payment for the Services provided is carried out through the ND CHARGER mobile application using BOD.
3.3. The volume of Services provided when tariffed by kW/h is determined by the technical means of electricity metering installed in the EPS, and the User fully trusts it and accepts the volume of Services provided. The amount of electricity received, determined by the electric vehicle, does not serve as the basis for establishing the volume of Services provided and payment for them.
3.4. The User's funds, which are credited to the Operator's bank account as payment for the volume of Services provided, are subsequently at the full disposal of the Operator.
4. Rights and obligations of the parties
4.1. The operator undertakes:

4.1.1. Organize the provision of the Service at the EZS if it is possible to write off funds from the User’s Balance sufficient to provide the Service.
4.1.2. Ensure the organization of provision of the Service to the User within 60 minutes from the moment of Registration.
4.1.3. Keep records of Services provided at the EPS through the ND CHARGER Service.
4.1.4. Provide up-to-date information about the Status of charging station connectors, Tariffs in the ND CHARGER service, visualize data on received Services in the User Account, and also organize technical support.
4.1.5. Provide the User with statistical information about the Services provided within his account.
4.1.6. Inform the User about the repair or maintenance of the EPS on the card in the ND CHARGER mobile application.
4.1.7. Provide information support to Users through its Help Desk or in other ways available to the Operator.
4.1.8. Ensure the confidentiality of the User's personal data, as well as information that constitutes banking secrecy in accordance with the legislation of the Republic of Uzbekistan.
4.1.9. Publish messages in the ND CHARGER services about changes to this Agreement and/or other significant events and news, including information about changes introduced into the ND CHARGER service.
4.1.10. In case of any claims by the User, including claims on accounts, the Operator is obliged to process them no later than 30 (thirty) calendar days from the date of application.
4.1.11. Provide a receipt confirming the fact of crediting funds to the User's Balance.
4.2. The operator has the right:
4.2.1. Unilaterally, independently, based on market conditions and/or personal understanding, introduce additional paid

services or change the Tariff for existing Services by amending the Agreement and updating information on the ND CHARGER service.
4.2.2. Unilaterally change the settings, design, graphic materials, address and name of the ND CHARGER Mobile application, while re-Registration of an already registered User is not required.
4.2.3. Unilaterally refuse to fulfill this Agreement at his own discretion, as well as in the event of there being justified (recorded by the Operator, financial institutions, companies receiving payments) grounds to believe that the User committed actions that were aimed at deteriorating the quality of services, the reputation of the Operator, causing damage to property, equipment, software of the Operator, used stolen means of payment and/or made fraudulent payments.
4.2.4. Interrupt the provision of Services in the event of preventive or repair work (maintenance of EPS and/or ND CHARGER service).
4.2.5. Interrupt the provision of services to the User if he uses a faulty (low-quality, uncertified) electric vehicle (charging cable, adapter) until he eliminates the relevant malfunctions.
4.2.6. Charge the User an additional fee for not disconnecting the electric vehicle from the EPS (failure to return the EPS charging cable to the appropriate holder) within 10 minutes after the end of the Charging session or for not releasing a parking space for refueling.
4.2.7. On the basis of contracts or other methods not prohibited by the current legislation of the Republic of Uzbekistan, attract third parties in order to provide services more efficiently.
4.2.8. Change the location of EZS, increase or decrease their number.
4.2.9. Do not return to the User’s Balance the written-off Cost that exceeds the actual volume of Services provided during charging

per kW/h, in the event of a technical failure of the system and failure to report this to the Support Service by the User within 10 days.
4.2.10. At your discretion, provide video surveillance of the EPS and data storage, insure property or liability to third parties, provide WiFi access to the EPS, etc.
4.2.11. Process the User’s personal data for the purpose of fulfilling this Agreement.
4.3. The user undertakes:
4.3.1. To provide the Service at the EPS, register on the appropriate ND CHARGER service in accordance with the Terms of Use.
4.3.2. Ensure the confidentiality of registration data (received passwords, identification numbers, etc.), and also bear full material and financial responsibility for all actions performed using a personal account in the ND CHARGER services.
4.3.3. Accept the payment terms established by this Agreement.
4.3.4. Comply with the terms of this Agreement and comply with the requirements of the current legislation of the Republic of Uzbekistan.
4.3.4. Before receiving the Services, carefully read this Agreement, the Terms of Use and Tariffs.
4.3.5. When making payments, use means of payment that the User is the owner of exclusively legally.
4.3.6. After completing the receipt of the Service, disconnect the electric vehicle from the EPS and free up a parking space for charging other Users.
4.3.7. Immediately (at the first opportunity), but no later than 24 hours, notify the Support Service about the receipt and/or use of the User’s login/password by a third party.
4.3.8. Do not use faulty (emergency) electric vehicles and charging cables (adapters) that do not correspond to the EPS for charging.

existing international standards or are uncertified or home-made modifications of energy supply systems, etc., which were not provided for by the corresponding manufacturer.
4.3.9. If the design of a slow charging station does not provide for the presence of a charging cable, in order to receive Services at this electric charging station, the User must use his own charging cable that meets the requirements of 4.3.8 and 4.3.22 of this Agreement.
4.3.10. When using the charging cable built into the Charging Station, after completing the Charging session, place the charging cable connector in the appropriate holder on the EPS.
4.3.11. Treat the EPS with care and leave the place where the Services are provided in an aesthetically appropriate condition.
4.3.12. Do not harm the property, software and reputation of the Operator, as well as the place where services are provided.
4.3.13. Do not transfer your rights and obligations to other persons, including not providing the opportunity for other persons to receive Services on behalf of the User.
4.3.15. Use the EPS solely for the purpose of charging the batteries of electric vehicles in accordance with the Rules of Use to prevent damage to property, injury or harm to the health of the User and third parties.
4.3.16. Immediately (at the first opportunity) through the Support Service, inform the Operator about any design defects or damage to the EPS in the Network of charging stations, incorrect operation of the EPS and the ND CHARGER service, other problems that the User encounters or about which he becomes aware while receiving services.
4.3.17. Use the Charging Station Network without limiting the rights of other Users or preventing them from receiving services.
4.3.18. Respect and follow the instructions and directions of the Operator’s personnel and/or employees and be available by phone specified in

User account for the purpose of contacting the Operator when using the Charging Station Network, if necessary.
4.3.19. Inform the Operator through the Support Service about any obstacles that may prevent the Operator from properly fulfilling the terms of this Agreement.
4.3.20. Ensure regular technical (service) maintenance of your electric vehicle.
4.3.21. Ensure that the peripheral equipment (including mobile phones or computers) and connections it uses are sufficiently secure against unauthorized use by third parties and viruses.
4.3.22. Perform and undergo technical (service) maintenance of the electric vehicle in accordance with the recommendations of the car manufacturer. Ensure that the electric vehicle and the charging cable used for it comply with the requirements of the current standards of the Republic of Uzbekistan and international technical standards.
4.3.23. Bear full liability and damages for all damages resulting from the use of a faulty electric vehicle or charging cable (by the user) when receiving the Service.
4.3.24. Monitor messages for Users of the ND CHARGER service published by the Operator in the relevant interfaces of the Service. Follow the requirements contained in these messages.
4.3.25. Immediately notify the Operator of facts or suspicions regarding the illegal use by third parties of details for accessing the Service, including the loss (loss, theft or other means of loss) of access to the mobile phone number to which the ND CHARGER service is connected.
4.4. The user has the right:
4.4.1. To receive free comprehensive up-to-date information from the Operator about Tariffs and the procedure for providing services on ND CHARGER services, while communication services are paid for by the User independently.

4.4.2. For high-quality receipt of the paid Service, which depends on the technical condition of the electric vehicle, power system parameters and other factors.
4.4.3 To unilaterally terminate this Agreement at any time, in the absence of unfulfilled obligations of the User to the Operator.


5. Price and payment procedure
5.1. To provide the Service, the User is obliged to pay the Operator the Cost of the Service.
5.2. The cost of the Service corresponds to the current Tariffs at the time of provision of the Service and the volume of the Service provided. Information about current Tariffs is posted in the ND CHARGER mobile application.
5.3. To receive Services, the User replenishes the User's Balance through the ND CHARGER Mobile application using the BPC, of ​​which he is the owner, by entering the BPC data and other confidential data.
5.4. The actual debiting of funds from the User's Balance occurs during the process and/or upon completion of the Charging session.
5.5. The amount of electrical energy consumed during the provision of the Service is intended to calculate the Cost of the service when tariffed by kW/h and is determined by electrical energy metering devices installed in the EPS.
Information about the amount of electrical energy used, determined by electrical energy measuring devices, is available to the User after the end of each charging session on the EPS display and/or in the ND CHARGER service.
5.6. The User's funds credited to the User's Balance are non-refundable and can be used exclusively to receive the Service.

5.7. After replenishing the User's Balance, the User is provided with a Receipt by providing the opportunity to download and/or print it from the Mobile Application.
If the Check is not presented to the User for any reason within 48 hours from the end of the billing period, the User is obliged to notify the Operator of this fact immediately.
6. Procedure for processing Personal data
6.1. The operator collects and stores only the personal information that is necessary to provide the ND CHARGER service, except in cases where the law requires the mandatory receipt and storage of certain personal information. Personal information is stored no longer than required by the purposes of processing, unless the storage period for such personal information is established by the legislation of the Republic of Uzbekistan.
6.2. The Operator may use the User’s personal information for the following purposes:
6.2.1. Execution of this Agreement, provision of Services.
6.2.2. Communications. Communication with the User, including sending notifications, requests and information regarding the use of the ND CHARGER service, as well as processing requests and messages from the User, including the subsequent transfer of such requests and applications for execution to third parties.
6.2.3. Conducting statistical and other studies based on anonymized data.
6.2.4. Carrying out marketing campaigns, including for the purpose of distributing advertising and information materials.
6.3. The Operator has the right to transfer the User’s personal information to third parties in the following cases:
6.3.1. The transfer is necessary to use the ND CHARGER service, including to execute the User’s orders.
6.3.2. Payment organizations involved in making transfers for debiting funds. In order to comply with due

the level of security of online payments made using bank cards, the Operator can transfer information, the list of which is established by the security protocols of payment systems, to acquiring/issuing banks and payment systems.
6.3.3. To the Copyright Holder of the License, in order to account for the number of Users.
6.3.4. An organization engaged in the physical storage of Personal Data, subject to the existence of an agreement and the assumption by this organization of the duties of the Operator for the Personal Data of Users.
6.4. The operator undertakes the following obligations:

6.4.1. Take legal, organizational and technical measures to protect personal data, ensuring:

· integrity and safety of personal data;

· maintaining the confidentiality of personal data;

· prevention of illegal processing of personal data.

6.4.2. Process personal data of Users strictly for the purposes of this Agreement;

6.4.3. Destroy personal data of Users in the event of:

· achieving the purpose of processing personal data;

· availability of withdrawal of the User's consent to the processing of personal data;

· termination of this Agreement for any reason;

· entry into force of a court decision.

6.4.4. Change and (or) supplement Personal data, subject to documentary confirmation of the accuracy of the new data, or destroy it if it is impossible to make such changes and (or) additions;
6.4.5. Temporarily suspend processing or destroy personal data if there is information about a violation of the conditions for their processing;
6.4.6. Ensure that Users can submit documents electronically for temporary suspension of processing and (or) destruction of their personal data;

6.4.7. Notify Users in an accessible form in cases of change, destruction of personal data and restriction of access to it.
6.4.8. When processing personal data, be guided by the Law of the Republic of Uzbekistan
“On Personal Data” and other regulations governing relations in the field of ensuring the security of personal data.
6.5. As part of the ND CHARGER service, the User is provided with the functionality to change (update, supplement) or delete the information provided by the User or part of it. Revocation of Consent to the processing of personal data must be in writing and sent by emailsupport@ndcharger.uz
6.6. Within the limits established by applicable law, the Operator notifies each recipient to whom the personal information was disclosed about the change or destruction of personal information, unless this turns out to be impossible or requires disproportionate effort.
6.7. The User has the right to access information received by the Operator, request information regarding: (a) the purpose of processing; (b) categories of data processed; (c) the category of recipients to whom the User’s personal data has been or will be transferred; (d) storage period or criteria for determining it, as well as other information.
6.8. If the Operator has reason to doubt the identity of the User submitting a request in accordance with clause 6.9. of this Agreement has the right to request additional information necessary to confirm the identity of such User.
6.9. Consideration of a request for information (copy) is carried out within thirty (30) days from the date of its receipt.
6.10. The Operator takes necessary and sufficient organizational and technical measures to protect the User’s personal information from unauthorized or accidental access, destruction, modification, blocking, copying, distribution, as well as from other unlawful actions of third parties.

7. Confidential information
7.1. The parties define the received data as confidential and undertake not to disclose the following information: login and password of the registered User to access the User’s account, personal and payment information of the User.
7.2. It is not considered a disclosure of personal and confidential information of Users in the following cases:
7.2.1. legal requirements of fiscal, judicial and other law enforcement agencies;
7.2.2. renaming the legal entity of the Operator;
7.2.3. sale of the Operator's company or the Operator's business to other legal entities;
7.2.4 mergers of the Operator’s business with other legal entities;
7.3. By accepting the terms of this Agreement, the Parties certify their understanding of all the negative consequences of disclosing this information.
8. Responsibility of the parties
8.1. The parties are responsible for non-fulfillment or improper fulfillment of the terms of this Agreement in accordance with the legislation of the Republic of Uzbekistan.
8.2. The User is responsible for any losses or other negative consequences arising from failure to fulfill or improper performance of obligations under this Agreement.
8.3. The user is solely responsible for the safety of his personal data when entering it on a device that uses unsecured connections or is at risk from malicious programs and applications.
8.4. The Operator is not responsible for improper fulfillment of the terms of the Agreement if such failure was a consequence of the failure to fulfill the terms of the Agreement by the User.
8.5. The Operator is not responsible for any losses incurred by the User due to the fact that the User has not read and (or)

timely read the terms of this Offer and the Terms of Use.
8.6. The Operator is not responsible for improper fulfillment of the terms of the Agreement if such failure is caused by reasons beyond the control of the Operator, including for failures caused by third parties, for the quality of public communication channels and interruptions in the power grid, as well as data transmission networks , with the help of which access to the Services is provided, for the condition and serviceability, repair and maintenance of any software and hardware that are not within the area of ​​its control, for the impact of deviations from the norms of the parameters of the power system and the technical condition of the electrical networks of third parties on the operation of the EPS and the quality of the services provided Services for failures due to prohibitions and restrictions imposed by government or judicial authorities.
8.7. The operator does not bear material and/or financial responsibility for incorrect functioning and connection failures during the operation of the ND CHARGER service, resulting from a malfunction of the mobile device that provides use of the ND CHARGER service, as well as due to technical and other problems.
8.8. The Operator is not liable to the User for any damage caused by the use of the Network of charging stations, in the event that the User fails to timely undergo maintenance of the electric vehicle at an official dealer, if design changes are made to the electric vehicle by an unofficial service center, if the electric vehicle is not intended for use in a given region, post-accident repair repair (restoration) of an electric vehicle by an unofficial service center.
8.9. The Operator is not responsible for the unauthorized receipt of the Service at the EPS using the User account created in accordance with this Agreement.
8.10. The Operator is not responsible for any consequences of the use and/or inability of the User to use the ND CHARGER service (including liability for the transfer and use by third parties of the User’s personal data transferred by the User during Registration), as well as for damage and (or) lost

benefits caused to the User or any third party as a result of such use and/or inability to use the ND CHARGER service.
8.11. The Operator is not responsible for the consequences of the User disclosing his login and/or password.
8.12. The Operator is not responsible for the inability to receive the Service or any information from the Operator due to incorrectly entered data by the User during Registration and BOD data.
8.13. The Operator guarantees the ability of the EPS to deliver the declared power current, but is not responsible for the quality and speed of charging in the event of features, malfunctions or defects of the User’s electric vehicle, including those related to the condition of the battery, the charging port of the electric vehicle, the corresponding controller, the User’s charging cable, etc. etc., and/or in the event of the User's electric vehicle being unable to accept the power current supplied by the charging station as a result of the internal control of the electric vehicle's battery management system.
8.14. The Operator is not responsible for the impossibility of carrying out a Charging session if the User does not have the charging cable necessary to charge the electric vehicle at the Operator's electric charging station.
8.15. The Operator is not responsible for negative consequences resulting from the User using his own charging cable (for harm caused to the health of the User or third parties, for damage to the property of the User or third parties, etc.).
8.16. The operator is not responsible for the impossibility of access to the electric charging station in the event of obstruction of access to it by other vehicles or in the event of untimely release of the charging port for other electric vehicles, as well as in the event of obstruction by the owner of the place of service provision.
8.17. The Operator is not responsible for the safety of the User’s electric vehicle and/or other property when receiving services and/or when parking in a parking space near the electric filling station.

8.19. The Operator is not responsible for any indirect negative consequences (including financial losses of the User) associated with the inoperability of the Network of charging stations due to the maintenance of electric charging stations, repair work and other routine and non-routine work.
8.20. The Operator is completely released from liability for complete or partial failure to fulfill its obligations under the Agreement if the failure or improper performance is a consequence of force majeure circumstances, namely: an accident (failure to operate) in power electrical or computer networks or other electrical communication systems used for operation Service, as well as as a result of deliberate unlawful actions of third parties aimed at disrupting the functioning of the service, acts of government or judicial authorities, terrorist attacks, earthquakes, fires, floods or other natural disasters, situations related to working conditions, power failures and Internet disruptions - connections.
8.21 The user is responsible:
8.21.1. For damage caused to the Operator’s property, equipment and software, and the place where services are provided, including damage caused by the User’s use of a faulty (low-quality, uncertified) electric vehicle (charging cable, adapter). If there is fault, the User shall reimburse the amount of damage caused. The provision of the Service to the User is terminated until full compensation for the damage;
8.21.2. For the confidentiality and safety of personal data and other information necessary to access and perform transactions in the ND CHARGER service, as well as for losses that may arise as a result of failure to comply with the requirements for ensuring the safety and confidentiality of such information;
8.21.3. For illegal access of third parties to the use of the ND CHARGER service from the User’s account as a result of the intent or negligence of the User himself and for all consequences caused by such illegal access;

8.21.4. For the accuracy, relevance, completeness and compliance with current legislation of the data specified during Registration and making payments;
8.21.5. The User bears the risks and responsibility for any actions of third parties performed on behalf of the User from his mobile phone number to which the ND CHARGER service is connected, as well as using applications and programs installed on his mobile device or using his details for accessing the ND service CHARGER.
In case of loss, theft or in other cases the User does not have access to the mobile (subscriber) phone number to which the ND CHARGER service is connected, the User bears all risks and liability for any actions of third parties associated with the use of the ND CHARGER service by third parties, up to the moment the Operator receives a statement from the User about loss of access to this number.
9. Duration and procedure for termination of the contract
9.1. The Agreement comes into force at the moment an individual accepts the Public Offer and is valid until the Parties fully fulfill their obligations under the Agreement.
9.2. The User has the right to refuse the Services at any time by deleting from the service in accordance with the Terms of Use and clause 9.4. actual agreement.
9.3. The Agreement may be terminated by the Operator unilaterally in accordance with the conditions specified in this Agreement.
9.4. Termination of this Agreement is carried out by deleting the User's account from the ND CHARGER service. The User's account can be deleted by the Support Service independently or at the User's request. If the account is deactivated at the initiative of the Support Service, requests for deletion from Users will not be accepted.
9.5. Changes or additions to this Agreement are published on the Operator’s Website and (or) in the ND CHARGER Mobile Application.

10. Final provisions

10.1. Due to objective reasons or changes in legislation relating to the implementation of the Service, the Operator reserves the right to unilaterally limit (suspend) the organization of the provision of the Service.
10.2. All disputes or disagreements arising in connection with the use of the ND CHARGER service must be resolved through negotiations based on a written complaint from the User. After receiving the User’s application, his claim is satisfied or the User is sent a reasoned refusal within 15 working days.
If an agreement is not reached through negotiations, the parties resolve their differences in court in accordance with the current legislation of the Republic of Uzbekistan.
10.3. All issues not regulated by the Agreement are resolved in accordance with the current legislation of the Republic of Uzbekistan.
